Anyone who accesses or uses the IHCantabria website becomes a USER thereof from the time of said access and/or use and accepts the Terms of Use specified herein. Said Terms shall apply irrespective of any other terms and conditions that may be required as appropriate.

  1. USE OF THE WEBSITE

www.ihcantabria.com provides access to a variety of online information, services, programs or data (hereinafter, the “Content”) belonging to IHCantabria or its licensors that the USER may have access to. USERS are responsible for their use of the website. This responsibility extends to any registration which may be necessary to access certain services or content.

When registering, the USER shall be responsible for providing accurate and licit information. Upon registering, USERS may be given a password for which they are liable, accepting responsibility for the diligent and confidential use thereof. The USER also undertakes to make appropriate use of the content and services (such as chat services, discussion forums or newsgroups) which the website owner provides via its website, and agrees not to use them for purposes including, but not limited to: (i) engaging in activities that are illicit or illegal, or that are contrary to good faith and public order; (ii) communicating content or propaganda of a racist, xenophobic, pornographic or illegal nature, or any content which advocates terrorism or attacks human rights; (iii) deliberately damaging the physical and logical systems belonging to the website owner, its suppliers or third parties, or inputting to or spreading through the network any computer viruses or any other physical or logical systems likely to cause the damage mentioned above; (iv) any attempt to access and, where appropriate, use the email accounts of other users and modify or tamper with their messages.

IHCantabria reserves the right to remove any comments and contributions which violate respect for human dignity; which are discriminatory, xenophobic, racist, or pornographic; which constitute an attack against youth or childhood, order or public safety; or which, in its opinion, are not suitable for publication. Under no circumstance will IHCantabria be held liable for the opinions expressed by users in forums, chats or any other tools used to participate on the website.

  1. DATA PROTECTION

IHCantabria complies with the Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data (General Data Protection Regulation or GDPR) and Organic Law 3/2018 on the protection of personal data and the guarantee of digital rights and all other corresponding legislation in force at any time, and seeks to ensure that the user’s personal information is properly used and processed. To this end, together with each form for collecting personal data, for services that the user may request from webmaster@ihcantabria.com, they will be informed of the existence of and asked to accept the specific conditions regarding the processing of their data as appropriate. The user will also be informed of the party responsible for the file created, the address of this party, the possibility of exercising their rights to access, rectification, erasure and object, the reason for processing personal data and, when appropriate, disclosure to third-parties.

In addition, IHCantabria informs you of its compliance with Law 34/2002, of 11 July, of the Services of the Information Society and Electronic Commerce, and will always seek consent from the User to process their emails for commercial purposes.

IHCantabria itself or as an assignee, is the holder of all of the intellectual and industrial property rights of its website, as well as of the elements contained therein (including but not limited to images, sound, audio, video, software and texts; trademarks or logos, combinations of colors, structure and design, selection of materials used, computer programs required for its operation, access and use, etc.), owned by IHCantabria or its licensors.

By virtue of the provisions of Articles 8 and 32.1, paragraph two, of the Spanish Intellectual Property Act, the following are expressly prohibited: any reproduction, distribution or public disclosure, including any means of making available all or part of the contents of this website for commercial purposes, in any form, or by any technical means, without the authorization of IHCantabria. The USER agrees to respect the intellectual and industrial property rights owned by IHCantabria. The USER may view items on the website and print, copy, and store them on their computer’s hard drive or any other hardware, provided that it is solely and exclusively for their personal and private use.

The USER shall refrain from removing, altering, bypassing or manipulating any safeguard or security system installed on the IHCantabria website.

IHCantabria shall not be held liable under any circumstances for any damage of any nature that may arise, including but not limited to: errors or omissions in the content, lack of availability of the website or the transmission of viruses, malware or harmful programs through the content, despite having taken all necessary technological measures to prevent this from occurring.

IHCantabria reserves the right to make any changes that it deems appropriate to its website with no prior warning, being entitled to modify, delete or add content and services provided through the website and the way in which they are presented or located.

Likewise, the inclusion of these external links implies no partnership, merger or shareholding whatsoever with the linked companies.

IHCantabria reserves the right to refuse or withdraw user access to the portal and/or the services offered on it, with no prior notice, at its own discretion or that of any third party, if these Terms of Use are violated.

IHCantabria  shall respond to the breach of these terms and conditions and any misuse of its website by pursuing all legally applicable civil and criminal channels.

The relationship between IHCantabria  and the USER shall be governed by the Spanish law in force and any dispute shall be submitted to the Courts of Santander.
